What Is A Lawyer's Role In Mediation?

One of the most important steps in family law matters is mediation. In most cases, parties are expected to make a genuine attempt to resolve their dispute before commencing Court proceedings and, where proceedings have been filed, the Court will often direct the parties to participate in mediation or another form of dispute resolution.

While mediation provides an opportunity for parties to reach an agreement together, having an experienced family lawyer by your side can make a significant difference. Below are some of the ways a lawyer can assist before, during and after mediation.

Preparation

Good preparation is often the key to a successful mediation.

Your lawyer will advise you about your legal rights and entitlements, explain the mediation process, and help you understand what outcomes are realistic. They will also liaise with the other party to ensure disclosure is complete and that any Court orders or procedural requirements have been complied with.

Where appropriate, your lawyer will prepare documents such as a position statement or a proposed Minute of Order, allowing the mediator and the other party to clearly understand your position before negotiations begin.

During the Mediation

Throughout the mediation, your lawyer will provide ongoing advice about any offers made by the other party and help you assess whether those offers are reasonable and in your best interests.

They will also speak on your behalf when appropriate, negotiate directly with the other party's lawyer, and assist the mediator to identify the real issues in dispute while narrowing unnecessary areas of disagreement.

This can be particularly valuable if you feel overwhelmed by the process, are unfamiliar with your legal rights, or find it difficult to negotiate confidently. Having legal representation helps ensure you make informed decisions and are not pressured into accepting an outcome that is not in your best interests.

Following Mediation

If an agreement is reached, your lawyer will prepare the necessary documents to properly record the agreement and ensure it is legally enforceable. They will also identify and address any gaps or issues before the agreement is finalised.

If the matter does not settle, your lawyer will advise you on your options moving forward and continue to represent you through the next stage of your matter, whether that involves further negotiations or Court proceedings.

For many people, mediation is an unfamiliar experience. Understanding the process, knowing your legal position, and negotiating effectively can be challenging without professional guidance.
